What this skill does

When a loan is in default and you have agreed to hold off for a set time while the borrower sells, refinances or fixes the problem, this drafts the forbearance agreement. The borrower gets time; you get a signed acknowledgment of the default and the debt, a release of claims, the guarantors' signatures and firm deadlines. Draft for attorney review.

What it does

  • Builds a term sheet for the forbearance: period, payments, fee, default interest, deadlines and what happens at the end
  • Rewrites vague promises like "best efforts to sell" into dated deadlines you can check
  • Drafts the agreement: acknowledgment of the defaults and balance, a clear statement that the defaults are not waived, conditions before it takes effect, payments, release and guarantor joinder
  • Spells out the events that end the forbearance and what you can do next
  • Writes a one-page summary for the lender and a milestone tracker

When to use it

  • A loan is in default or past maturity and you have agreed to give the borrower time
  • The borrower has a sale, refinance or completion in sight and needs a window
  • You want the defaults and the balance acknowledged before you hold off
  • Guarantors need to reaffirm and release claims

What to have ready

  • The agreed forbearance terms
  • The loan documents and any default or maturity notices sent
  • A balance statement as of a stated date
  • Where any foreclosure or other enforcement stands

How to use it

  1. Download it with the button above. You'll sign in with a work email — that's how the creator knows who is using their skill.
  2. Copy the install prompt from the "Run it in Claude" box, and paste it into Claude along with the file. Claude installs the skill, fills in your firm's details where the file has [BRACKETED] placeholders, and runs a quick test with you.
  3. Then just ask in plain English. Claude picks the skill up on its own when a request matches it. Anything it still needs, it asks you for — it won't invent a number.

"[BORROWER] is past maturity on [PROPERTY ADDRESS]. We agreed to hold off [N] days if they list by [DATE], sign a sale contract by [DATE] and pay a [AMOUNT] fee. Here are the loan docs, our default notice and the balance statement. Draft the forbearance agreement."

What you get back

A one-page lender summary, a forbearance term sheet, a full draft agreement, a milestone tracker, a checklist for your attorney and a list of terms still to be agreed.

Good to know

  • Output quality tracks input quality. A missing figure is flagged as missing — it is never estimated to fill a gap.
  • Every draft is a starting point for your own review, not a finished decision.
  • Runs anywhere Claude does: the Claude app, Claude Desktop, or Claude Code.
  • It never waives a default unless you decide to, flags any guarantor who will not sign, and leaves state-specific foreclosure and release questions to your attorney.

Legal disclaimer

This skill drafts; it does not decide. Its output is not legal, tax, accounting, appraisal, or investment advice, and using it creates no attorney-client, fiduciary, or advisory relationship. Nothing it produces is a commitment to lend or an offer to sell a security. Verify every number, date, citation, and conclusion against the source documents, and have a qualified professional licensed in the relevant jurisdiction review the work before you rely on it or send it to a borrower, investor, counterparty, or regulator. What it does
Use when a private loan is in default and the lender has agreed to hold off on remedies for a limited time while the borrower sells, refinances or cures. Trigger on "draft a forbearance agreement," "forbearance on this loan," "we'll hold off on foreclosure if," "standstill with the borrower," "give them 90 days to sell," "forbearance with milestones," "acknowledge the defaults," "forbearance fee," "conditional waiver of default interest," "termination events," or when agreed forbearance terms are attached with the loan documents, default notices and a balance statement. Drafts the agreement — default and balance acknowledgment, forbearance period, conditions precedent, milestones, payments, fees, release, guarantor joinder and termination events — plus a one-page term summary for the lender and the checklist counsel must confirm. Draft for attorney review only.

Forbearance Agreement Drafter

A forbearance agreement trades time for certainty. The borrower gets a defined window to sell, refinance or cure; the lender gets an acknowledgment of the default and the debt, a release of claims, fresh guarantor commitments, milestones with teeth and a faster path to its remedies if the borrower misses them. Drafted badly, it does the opposite — it waives the default, resets notice periods, or gives the borrower's counsel a new argument. This skill drafts the agreement from the business terms the lender has agreed, so the lender's position is better at the end of the window than at the start.

It works for defaulted or matured bridge, fix-and-flip, construction, land and small-balance commercial loans made for business purposes.

Where it fits: problem-loan-and-modification-analyst decides whether forbearance is the right path; extension-workout-strategy-builder is the borrower's side of the conversation; maturity-extension-request-evaluator handles extension requests on performing loans; loan-modification-agreement-drafter is for a permanent change to terms. This skill drafts the forbearance agreement once the lender has decided to forbear.

Everything here is a draft for review and completion by the lender's attorney. Foreclosure procedure, notice requirements, release wording and the effect of a forbearance on a pending enforcement action vary by state. Nothing here is a legal conclusion.
