What this skill does
Puts a broker's fee in writing before the deal is shopped: how much, on what amount, when it is earned, and who pays. Drafts the agreement from your own terms and lists the state licensing, upfront-fee and disclosure questions your attorney needs to answer before anyone signs.
What it does
- Drafts a broker–borrower fee agreement, a broker–lender compensation agreement, or both
- Makes the four points that cause fee disputes explicit: what the fee is calculated on, when it is earned, when it is paid, and any minimum
- Adds a tail period tied to a written list of lenders you actually introduced, and non-circumvention terms for the lender side
- Flags the questions for counsel: licensing in the property's state, fees collected before funding, required disclosures, pay from both sides, state fee limits
- Runs a pre-signature check so parties, amounts and disclosures all agree
When to use it
- Before you shop a borrower's deal to lenders
- When a lender wants to pay you and you need non-circumvention in writing
- When a borrower went direct to a lender you introduced and you want it covered next time
- When you work a deal in a state where you have not brokered before
What to have ready
- Which agreement you need: with the borrower, the lender, or both
- The property's state and confirmation the loan is for business purposes
- Your license status and your fee terms
How to use it
- Download it with the button above. You'll sign in with a work email — that's how the creator knows who is using their skill.
- Copy the install prompt from the "Run it in Claude" box, and paste it into Claude along with the file. Claude installs the skill, fills in your firm's details where the file has
[BRACKETED]placeholders, and runs a quick test with you. - Then just ask in plain English. Claude picks the skill up on its own when a request matches it. Anything it still needs, it asks you for — it won't invent a number.
"Draft a fee agreement with my borrower for a [LOAN TYPE] in [STATE] — [X] points on the total loan, paid at funding, 90-day exclusive with a tail."
What you get back
A draft agreement marked for attorney review, led by the open licensing and disclosure questions, with a fee summary, clause-by-clause text, an introduced-lender exhibit and a pre-signature checklist.
Good to know
- Output quality tracks input quality. A missing figure is flagged as missing — it is never estimated to fill a gap.
- Every draft is a starting point for your own review, not a finished decision.
- Runs anywhere Claude does: the Claude app, Claude Desktop, or Claude Code.
- Never states a fee cap or licensing rule as law, collects nothing before funding by default, and will not draft agreements for owner-occupied consumer loans.
Legal disclaimer
This skill drafts; it does not decide. Its output is not legal, tax, accounting, appraisal, or investment advice, and using it creates no attorney-client, fiduciary, or advisory relationship. Nothing it produces is a commitment to lend or an offer to sell a security. Verify every number, date, citation, and conclusion against the source documents, and have a qualified professional licensed in the relevant jurisdiction review the work before you rely on it or send it to a borrower, investor, counterparty, or regulator. Laws, rates, and market data change. The final work product is yours.

Broker Fee Agreement Drafter
Brokers lose fees in three ways: there was nothing in writing, the writing did not say when the fee was earned, or the broker was not licensed where the property sits and the agreement could not be enforced. The first two are drafting problems. The third has to be checked before the agreement is worth anything. This skill drafts from the broker's own terms and puts the licensing and disclosure questions in front of them — and their counsel — before the borrower signs.
Works for: brokers arranging business-purpose private loans — bridge, fix-and-flip, DSCR rental, construction, land, small-balance commercial — with either a broker–borrower fee agreement or a broker–lender compensation agreement. For the licensing question itself, run state-licensing-navigator. For California loans that need the Mortgage Loan Disclosure Statement, see mlds-re883.
Step 1 — Intake
| Input | Required? | Notes |
|---|---|---|
| Agreement type | ✅ | Broker–borrower (borrower pays or authorizes the fee) or broker–lender (lender pays, plus non-circumvention). Both can exist on one deal |
| Loan purpose | ✅ | Business purpose, or will the borrower or family occupy it? Consumer loans are out of scope — see Step 2 |
| Property state(s) | ✅ | Licensing and disclosure rules follow the property, and sometimes the borrower's or broker's state too |
| Broker's license status | ✅ | License type, state(s), and number as [LICENSE TYPE / NUMBER]. "None" is a valid answer that changes Step 2 |
| Fee terms | ✅ | Amount or percent, basis (total commitment or initial funding), minimum fee, who pays, when earned, when paid |
| Lender-paid compensation | Helpful | Whether the broker will also be paid by the lender, and how it is disclosed |
| Exclusivity and term | Helpful | Exclusive or non-exclusive, length, and any tail period after termination |
| Upfront money | Helpful | Any retainer, application fee, or deposit before funding. See Step 2 before including one |
| Parties | ✅ | Legal names, entity types, signers. [BORROWER ENTITY], [BROKER ENTITY] until supplied |
Minimum viable: agreement type, loan purpose, property state, and the fee terms. Without license status the draft is produced, but the cover note leads with that open question.
